This criminal revision petition has been filed against the

judgment and order dated 12.03.2020 passed by the Judge, Family

Court, Sonamura, Sepahijala Judicial District in Criminal Misc. 52 of

2018 directing the husband (present petitioner) to pay monthly

maintenance allowance of a sum of Rs.15,000/- to his wife and their

minor daughter (respondents herein) w.e.f. 12.03.2020 i.e. the date on

which the said judgment was passed by the learned Family Judge.

Husband was directed to remit the said sum of monthly maintenance

allowance to his wife by means of money order within the 7th day of

every month succeeding the month for which the amount would fall

due.

Mr. R. Datta, learned P.P is representing the State

respondent.

Perused the judgment of the Family Court as well as

other documents annexed to the petition.

Petitioner husband has challenged the said judgment of

the Family Court on various grounds. One of those grounds is that the

amount granted by the Family Court is exorbitant and the petitioner

husband does not have the ability to pay such huge amount of

maintenance of his wife and daughter.

The petition stands admitted subject to the condition

that the petitioner husband would be paying maintenance allowance of

a sum of Rs.10,000/- per month for the maintenance of his wife and

daughter by the mode prescribed by the Family Court till disposal of

this criminal revision petition.

Issue notice returnable within three weeks. Steps be

taken for issuing notice to the respondents within five days from today.

It would be reflected in the said notice that the respondents would be

entitled to free legal aid from the High Court Legal Services Committee

for defending the case before this court.

Call for the LC record.

List the matter on 10.09.2021.
