Order 19/04/2021 Heard Mr. P. Chakraborty, learned counsel appearing for

the applicant and also heard Mr. S. Adhikari, learned counsel

appearing for the respondents No.1, 2, 3A, 3B, 3C & the

respondents No.4 & 5 and also heard Mr. P. S. Roy, learned

counsel appearing for the respondent No.6.

This is an application for condoning the delay of

323(three hundred and twenty three) days in filing the appeal

under Section 54 of the Land Acquisition Act from the

judgment and award dated 23.05.2019 delivered in Misc.(LA)

No.45 of 2012 by the Land Acquisition Judge, Sepahijala

District, Sonamura.

The respondents have not filed any objection against the

said prayer.

Having perused the reasons assigned in this application

even though this court is not adequately satisfied, but since

this is a matter of first appeal, this court would adopt a liberal

approach.

Accordingly, the delay stands condoned.

In the result, this application stands allowed and disposed

of.
