HON'BLE MR. JUSTICE ARINDAM LODH _O_ R_ D_ E_ R_ 08/04/2021 Heard Mr. S. Sarkar, learned senior counsel assisted by Ms. P. Chakraborty, learned counsel appearing for the applicant. Also heard Mr. R. Datta, learned P.P. appearing for the respondent-State.

This is an application under Section-389 of Cr. P.C. praying for suspension of the judgment and order of conviction and sentence dated 19.03.2021 passed by the learned Sessions Judge, Gomati Judicial District, Udaipur, Tripura in connection with Case No. S.T. 15 (GT/U) of 2015 to release the applicant on bail pending disposal of the connected Criminal Appeal.

The appeal filed by the applicant has been admitted for hearing. So, the judgment and order of conviction and sentence dated 19.03.2021, passed by the learned Sessions Judge, Gomati Judicial District, Udaipur, Tripura in Case No. S.T. 15 (GT/U) of 2015 shall remain suspended till disposal of the connected appeal.

Considering all aspects, the operation of the judgment and order of conviction and sentence dated 19.03.2021, is suspended pending final disposal of the appeal and in the meantime, the applicant, namely, Sri Rajib Nama Das, may be released on bail on furnishing a bail bond of Rs. 50,000/- [Rupees fifty thousand] with one surety of like amount to the satisfaction of the learned Sessions Judge, Gomati Judicial District, Udaipur, Tripura.

In view of above, the interlocutory application stands allowed and thus, disposed.
