HON'BLE MR. JUSTICE S. TALAPATRA Order 05.04.2021 Heard Mr. Somik Deb, learned senior counsel appearing for the petitioners as well as Mr. D. Bhattacharjee, learned GA assisted by Ms. N. Chakma Saha, learned counsel appearing for the respondents.

It appears from the records that the respondents have filed individual affidavits and expressed their remorse that they could not comply the order within the stipulated time for the pandemic situation. But one of the petitioners, namely Subal Das has already been appointed as the Driver, Grade-III, Group-C pursuant to the judgment and order dated 30.08.2019 delivered in W.P.(C) No.646 of 2019 by the order dated 24.03.2021. As far as the other petitioner is concerned, the respondent No.3 who was holding the post of Secretary to the Government of Tripura, Rural Development Department has undertaken that in order to comply the order of this court, steps have been taken following all necessary codal formalities to create a post of supernumerary basis for awarding promotion to Sri Manik Das, Gr-D in the post of Driver (Gr-C). It has been further stated in that affidavit that the Government is keen to comply with the order of the Hon'ble Court but due to the covid pandemic situation the same order could not implemented.

In view of the said development, this proceeding stands closed. The notices as issued are discharged. However, if within the reasonable time, the said undertaking is not implemented, the petitioner may resort to filing a fresh contempt petition again for non-compliance.
