Heard Mr. M. Bhushan Reddy, learned counsel for the

petitioners, and Mr. K. Goutham Kumar Reddy, learned Assistant

Government Pleader for Mines and Geology, appearing for

respondent Nos.1 and 4.

2. Learned Assistant Government Pleader for Mines and

Geology placed on record written instructions and submitted that

permissions have been granted by the District Level Sand

Committee, Kamareddy District for de-casting of sand and remove

debris so as to ensure free flow of water. Permission was granted

after obtaining No Objection Certificate from the concerned

departments including the Irrigation and Ground Water

department. The activity is confined exclusively for removing

flood deposits for restoration of agricultural land. No extraction

activity has commenced till date. The administration has in fact

have adopted stringent enforcement and preventive mechanisms to

curb illegal sand mining which includes establishment of four (4)

permanent check-posts with 24X7 deployment of Revenue and

Police personnel. There is continuous day and night patrolling,

even on holidays, by responsible officers including Senior

Assistants, Revenue Inspectors, Deputy Tahsildars and Tahsildars.

There is physical trenching of access roads to completely block

entry of heavy vehicles and machinery into sensitive zones.

3. It is further submitted that the Government has

operationalized the "Mana Isuka Vahanam" digital monitoring

system with effect from 01.04.2026 ensuring complete

transparency, traceability, and prevention of any authorized sand

movement. The writ petition is based on unfounded allegations

and misrepresentation of facts. The de-casting of sand will

improve the free flow of water in the stream and proper functioning

of the check-dam at Gundenemilli Village, Bichkunda Mandal,

Kama Reddy District. This area is at a distance of 200 meters from

the check-dam.

4. According to learned counsel for the petitioners, local sand

traders and contractors have been lifting and transporting sand

beyond the permitted area. The illegal sand mining will cause

(a) loss of fertile top soil and agricultural land due to unauthorized

excavation, (b) damage to standing crops, (c) threat to the

structural integrity of the land due to deep sand excavation pits

near the river, (d) blockage of irrigation channels, (e) threat of

flooding and soil erosion due to destabilization of riverbanks and

(f) depletion of ground water level and also the borewell in and

around that area. The petitioners submitted representation dated

23.03.2026 requesting respondent authorities to take action to

cancel the quarry permission and protect the check dam and

livelihood of the farmers.

5. In the above circumstances, considering the grievance of the

petitioners, the writ petition is disposed of, directing respondent

Nos.2 and 3 to consider the representation of the petitioners and

others dated 23.03.2026 regarding unauthorized excavation of sand

at Bandaranjal Village, Bichkunda Mandal, Kama Reddy District,

and pass orders, in accordance with law, by issuing notice to the

petitioners and all other concerned/interested persons, by affording

opportunity of hearing to them, within a period of four (4) weeks

from the date of receipt of a copy of this order. There shall be no

order as to costs.

As a sequel thereto, miscellaneous applications, if any,

pending in the writ petition stand closed.
