This Writ Petition is filed under Article 226 of Constitution of India seeking the following relief/s:-
"...to issue a Writ, Orders or Direction, particularly in the nature of Writ of Mandamus declaring the action of the Respondent No.3 in not taking any action on the representation submitted via Meeseva Application No.15200109251319534874, dt. 01.09.2025 and to register the complaint submitted for missing of original Sale Deed dated.30.08.2021 bearing Document No.5575/2021 which is arbitrary, illegal and consequently direct the respondents to register the complaint submitted through meeseva Application No.15200109251319534874, dated.01.09.2025 and pass such other order or orders ..."
2. Heard Sri Dadi Radha Krishna, learned counsel for the
petitioner and Sri M.Srinivas, learned Assistant Government
Pleader for Home appearing for respondents. Perused the
record.
3. The brief facts of the case are that the petitioner's son and
daughter in law are the lawful owners of the showroom No.5
located on the first floor, admeasuring 657.50 sq. ft out of 1315
sq. feet (inclusive of common area) together with undivided
share of the land admeasuring 12.5 sq. yrds along with car
parking area admeasuring 120 sq. ft. in second cellar in the
premises bearing M.No.8-2-609/1/1/A/Plot No.63 & 66 &
M.No.8-2-609/1/1/A/63 & 66/A corresponding to old M.No.8-
2-609/1/1/A, admeasuring 3059 sq. yrds in Plot No.63 & 66 in
Sy.No.120 & 121 of Shaikpet Village, situated at Road No.10,
Banjara Hills, Hyderabad by virtue of a registered sale deed
bearing document No.5575 of 2021 dated 30.08.2021. It is
stated that the petitioner's son and daughter-in-law sold the
property to one Smt. Sheetal Gupta, W/o. Sri. Ashwin Gupta on
18.07.2025 and executed a subsequent sale deed by handing
over the document bearing No.5575 of 2021 dated 30.08.2021
to the petitioner. After completion of registration on 18.07.2025
the petitioner took the original sale deed along with other
documents from Smt.Sheetal Gupta and lost the same. The
petitioner's consistent efforts to trace out the documents have
gone in vain. Therefore, the petitioner lodged a written
complaint before respondent No.3 on 01.09.2025 reporting the
loss of registered Sale Deed document bearing No.5575 of 2021
dated 30.08.2021 through Mee-seva application
No.15200109251319534874, dated.01.09.2025. But respondent
No.3 failed to take any action on the said complaint. Hence, the
petitioner filed the present Writ Petition.
4. Learned counsel for the petitioner submits that the
petitioner intends to produce the registered Sale Deed document
bearing No.5575 of 2021 dated 30.08.2021 as secondary
evidence before the competent Court to prove the title over the
property. As respondent No.3 failed to take any action on the
complaint submitted through Mee-seva application
No.01.09.2025, relying on the decision passed by the Hon'ble
Supreme Court in Lalitha Kumari Vs. Government of Uttar
Pradesh 1 and Smt J.Yashoda Vs. Smt K.Shobha Rani 2, he
seeks indulgence of this Court to pass appropriate orders.
5. Learned Assistant Government Pleader for Home, by
furnishing the copy of written instructions dated 23.03.2025
addressed by the Sub-Inspector of Police, Banjara Hills Police
Station, Hyderabad contends that the Commissioner of Police,
Hyderabad forwarded the representation of the petitioner to the
respondent No.3/the Station House Officer, Banjara Hills Police
Station, Hyderabad on 09.09.2025. Upon due verification,
respondent No.3 rejected the petitioner's representation through
(2014) 2 SCC 1 2 (2007) 5 SCC 730
Mee-seva application on 09.10.2025 i.e., on the same day itself.
Since, the cause in this Writ Petition does not survive for
adjudication, he seeks to dismiss this Writ Petition.
6. Having regard to the submissions of both the learned
counsel and on perusal of the written instructions dated
23.03.2025 addressed by the Sub-Inspector of Police, Banjara
Hills Police Station, Hyderabad, this Court, without making any
observations on the merits or demerits of the case, deems it
appropriate to direct respondent No.3 to conduct a detailed
enquiry on the representation submitted by the petitioner
through Mee-seva application No.15200109251319534874,
dated 01.09.2025 duly taking into consideration, the aspect of
the genuineness of the missing document and take appropriate
action strictly in accordance with law, as expeditiously as
possible, preferably within a period of thirty (30) working days
from the date of receipt of a copy of the order.
7. With the above direction, this Writ Petition is disposed of.
No costs.
As a sequel, the miscellaneous petitions pending, if any,
shall stand closed. No costs.
