ORDER
This Criminal Petition is filed under Section 482 of the Code of
Criminal Procedure, 1973 ("Cr.P.C."), seeking quashment of the
proceedings against the petitioner in C.C.No. 189 of 2023, pending on the
file of the learned I Additional Junior Civil Judge, Huzurabad.
2. The petitioner is arrayed as accused No. 4 in the aforesaid
Calendar Case, which arises out of a crime registered for the offences
punishable under Sections 290, 323, 506 read with Section 34 of the
Indian Penal Code, 1860 (IPC).

3. I have heard Mr. A.S. Diwakar, learned counsel, representing
Mr. Ashok Reddy Kanathala, learned counsel for the petitioner, Mr. M.
Vivekananda Reddy, learned Assistant Public Prosecutor, representing
respondent No.1-State and Mr. K. Buchi Babu, learned counsel for
respondent No.2.
4. Learned counsel for the petitioner would fairly submit that this Court
had granted interim order on 14.03.2024 dispensing the physical
presence of the petitioner/accused No.4 in the proceedings of C.C. No.
189 of 2023 before the trial Court subject to certain conditions. As the
petitioner is intending to see through the process, prayed for making the
interim order absolute, pending the Calendar Case proceedings and to
dispose of this petition.
5. Learned Assistant Public Prosecutor and learned counsel for
respondent No.2 reported no specific objection for the prayer, however,
pleaded for a direction for appearance of the petitioner on the material
stages of the proceedings.
6. Having regard to the limited prayer and having considered the
interim order granted earlier, without going into merits, extending the
interim relief of dispensing with the petitioner's presence, pending the
Calendar Case proceedings, is found not objectionable. Accordingly, the
petitioner's presence in the proceedings of C.C.No. 189 of 2023 pending
NTR,J
on the file of the learned I Additional Junior Civil Judge, Huzurabad, is
dispensed with subject to the conditions that her appearance through her
counsel on every adjournment and petitioner's physical presence as and
when directed by the trial Court. Additionally, it is specified that any lapse
in abiding the above conditions would render this order ineffective.
7. With the above direction, this Criminal Petition is disposed of.
Pending miscellaneous applications, if any, shall stand closed.
