                            ORDER

This Criminal Petition has been filed by the

petitioner/accused No.2 seeking to quash the

proceedings in F.I.R.No.205 of 2026 of Malkajgiri Police

Station, Malkajgiri District, for the offences punishable

under Sections 126(2), 223 and 292 read with 3(5) of

the Bharatiya Nyaya Sanhita, 2023 (for short, 'the

BNS').

2. Heard Mr.C.H.Jayakrishna, learned counsel for the

petitioner, and Sri Jithendar Rao Veeramalla, learned

Additional Public Prosecutor for respondent No.1.

3. With the consent of both counsel, the criminal

petition is disposed of at the admission stage.

4. Learned counsel for the petitioner submitted that the

petitioner has not committed any offence and has been

falsely implicated in the present case. Even accordingly

to the allegations made in the complaint, the

ingredients of the offences under Sections 126(2), 223

and 292 read with 3(5) of the BNS are not attracted. He

further submitted that the issue raised in this criminal

petition is squarely covered by the orders passed by this

Court in Crl.P.Nos.41 and 54 of 2025, dated

04.02.2025, and Crl.P.No.16117 of 2024, dated

07.01.2025, and also placed the copies of the said

orders. The petitioner is also entitled for the very same

relief. Hence, the continuation of the proceedings

against the petitioner is a clear abuse of the process of

law.

5. The said submission has not disputed by learned

Additional Public Prosecutor.

6. Taking into consideration the orders passed by this

Court in Crl.P.Nos.41 and 54 of 2025, dated

04.02.2025, and Crl.P.No.16117 of 2024, dated

07.01.2025, and in view of the submission made by the

both counsel, this Court finds it to be a fit case to

exercise jurisdiction under Section 528 of the BNSS to

quash the proceedings against the petitioner herein.

7. Accordingly, the Criminal Petition is allowed and the

proceedings in F.I.R.No.205 of 2026 of Malkajgiri Police

Station, Malkajgiri District, against the

petitioner/accused No.2, are hereby quashed.

Miscellaneous applications, pending if any, shall

stand closed.
