WRIT PETITION No.28999 of 2025
ORDER:
Heard Mr. Srikanth Hariharan, learned counsel appears
for Mr. Rohit Pogula, learned counsel for the petitioner;
Mr. Tandra Ramesh, learned Assistant Government Pleader for
Health, Medical and Family Welfare Department appearing for
respondent No.1 and Mr. T.Sharath, learned Standing Counsel
for Kaloji Narayana Rao University of Health Sciences appearing
for respondent Nos.2 and 3 (for short 'the University').
2. The petitioner filed this writ petition seeking a direction to
the respondents to permit him to register online and exercise
web option for admission into MBBS/BDS course under
Management Quota "B" category for the academic year
2025-2026 in the ongoing or next phase of counselling.
3. Learned counsel for the petitioner submits that
inadvertently the petitioner could not register for admission
under Management Quota "B" category. Therefore, the
University is not permitting him to seek admission under
Management Quota "B" category. He further submits that the
petitioner be granted liberty to submit a representation to the
University with regard to his grievance and on such
representation being filed, the University may be directed to
consider the same in line with similar order dated 21.08.2025,
passed by this Court, in other case such as W.P.No.24560 of
2025.
4. Learned Standing Counsel for the University submits that
the last date of applications for registration has been closed and
the University cannot extend the date. He submits that the
counselling process has commenced since 15.09.2025, after the
issue of 'local candidate' was decided by the Hon'ble Supreme
Court vide judgment dated 01.09.2025 in Special Leave Petition
(C) Nos.21536-21588 of 2024. Therefore, the University would
not be in a position to entertain the petitioner's application for
registration for admission to MBBS/BDS Course under
Management Quota 'B' category. It would be a futile exercise.
5. Having regard to the aforesaid circumstances and upon
consideration of the submission of learned counsel for the
parties, we are of the view that since the admission to
MBBS/BDS course has a definite timeline required to be
adhered to by the University and the cut off dates for
application or counselling are sacrosanct, there is no point in
asking the University to consider the petitioner's application for
fresh registration and participating in the ongoing counselling
for admission to MBBS/BDS course under Management Quota
'B' category. Therefore, we are not inclined to issue any
directions to that effect.
6. Accordingly, the Writ Petition is dismissed.
7. At this stage, learned counsel for the petitioner submits
that in case the date of applications for registration to the above
courses is extended, the petitioner may be granted liberty to
submit application for admission to MBBS/BDS Course under
Management Quota 'B' category and on such application being
filed, the University may be directed to consider the same.
8. It goes without saying that in case the date of applications
for registration to the above courses is extended, it would be
open for the petitioner to make such an application, which
would be considered by the respondents in accordance with
law.
As a sequel, miscellaneous petitions, pending if any,
stand closed. There shall be no order as to costs.
