Heard Mr. Papaiah Peddakula, learned counsel for the

petitioners - appellants, Mr. M. Kiran Reddy, learned counsel for

respondent Nos.1 and 2 and Mr. Praveen Kumar Challa, learned

counsel for respondent No.3.

2. The appellants filed a suit in O.S. No.66 of 2013 against the

respondents seeking partition and separate possession of suit schedule

properties. The said suit was dismissed vide judgment dated

22.06.2016 passed by learned Judge, Family Court - cum - VII

Additional District and Sessions Judge, Medak at Sangareddy.

Feeling aggrieved by the said judgment, the appellants preferred the

present appeal.

3. During pendency of the present appeal, the appellants filed

an interlocutory application vide I.A. No.2 of 2016 (ASMP No.2314

of 2016), seeking interim injunction. Vide order dated 23.01.2017,

this Court granted interim injunction. Even then, the respondents have

alienated the said properties to third parties. While so, due to

intervention of elders, the purchasers expressed their readiness to

compensate the appellants herein for the loss they sustained.

Therefore, the appellants are not intending to pursue the present

appeal. Accordingly, they have filed I.A. No.1 of 2025 seeking to

permit them to withdraw the present appeal.

4. Having satisfied with the reasons mentioned in the

accompanying affidavit, I.A. No.1 of 2025 is allowed. Consequently,

A.S. No.994 of 2016 is dismissed as withdrawn. In the circumstances

of the case, there shall be no order as to costs.

As a sequel thereto, miscellaneous applications, if any, pending

in the appeal case shall stand closed.
