JUDGMENT:

This appeal is filed by the appellant - defendant No.1 aggrieved by

the judgment and decree dated 06.10.2005 in O.S.No.215 of 1998 on the

file of the learned XII Additional Senior Civil Judge (FTC), City Civil

Court, Secunderabad.

2. No representation by learned counsel for the appellant

though the matter is posted under the caption 'for dismissal'.

3. Considering that the appeal is of the year 2005 and appellant

is not evincing any interest in prosecuting the matter, the appeal is

dismissed for non-prosecution. No order as to costs.

As a sequel, miscellaneous applications pending in this petition if

any, shall stand closed.
