               FAMILY COURT APPEAL NO.202 OF 2023

JUDGMENT:

Both parties are present in Court.

2. Learned counsel appearing for the appellant-wife and the

respondent-husband submit that the parties have entered into a

Settlement, agreeing to certain terms and conditions.

3. Counsel appearing for the appellant submits that the Family

Court Appeal may be disposed of by allowing the appellant's Appeal

for the dissolution of the marriage by mutual consent.

4. Since the Appeal has not been heard on its merits by this

Bench, we are not inclined to pass any orders with regard to the

dissolution of marriage between the parties. The parties are hence

given the liberty of approaching the concerned Family Court for

appropriate orders on the basis of the affidavit filed by the appellant

containing the terms and conditions on which the appellant's

F.C.O.P. for dissolution of marriage may be allowed.

5. The Trial Court shall be at liberty for considering the

affidavit/agreed terms and conditions in the context of the merits of

the matter, as the Trial Court may deem fit.

6. Since nothing further remains to be adjudicated, F.C.A.

No.202 of 2023, along with all connected applications, is disposed

of. The parties are also at liberty to refer to the Mediation Report

before the Trial Court. The Trial Court shall make an attempt to

decide the matter expeditiously upon the parties' approach. None of

the parties shall seek any adjournments before the Trial Court.

Interim orders, if any, shall stand vacated. There shall be no

order as to costs.
