COMMON JUDGMENT (Per the Hon'ble the Acting Chief Justice Sujoy Paul):
Sri K. Vasudeva Reddy, learned counsel for the appellant
and Sri P. Sri Harsha Reddy, learned Standing Counsel for
Singareni Collieries Company Limited, for the respondents.
2. Learned counsel for the appellant, during the course of
hearing, fairly admitted that although the services of the
appellant's father were wrongly terminated, his termination order
was not called in question by the appellant. Withstanding the
said termination order, no fault can be found in the order of
learned Single Judge in not directing consideration for
compassionate/dependant's appointment. He prays for
withdrawal of the writ petition and the writ appeal with liberty to
challenge the termination of his father's services in appropriate
proceedings and if he succeeds, revive his prayer for
compassionate/dependant's appointment.
3. The other side has no objection.
4. Accordingly, the writ appeal and the writ petition stand
dismissed as withdrawn with the liberty prayed for. It is made
clear that this Court has not expressed any opinion on the
merits of the case. No costs.
Interlocutory applications, if any pending, shall also
stand closed.
