Arbitration Application No.162 of 2025
ORDER:
Mr.Nawaz Hyder Ali, learned counsel representing
Mr.Aruva Raghuram, learned counsel for the applicant.
2. The present application has been preferred for
appointment of an independent arbitrator under Clause
17.1.c of the Sub-Lease Agreement dated 03.09.2022,
annexure P2.
3. However, learned counsel for the applicant at the
outset submits that in COMCA No.21 of 2025 arising out of
an order passed under Section 9 of the Arbitration and
Conciliation Act, 1996, a learned Division Bench of this
Court had vide judgment dated 06.08.2025 appointed an
arbitrator with consent of the parties to adjudicate the
dispute between the parties. He therefore seeks permission
to withdraw this Arbitration Application.
4. Accordingly, the instant Arbitration Application is
dismissed as withdrawn. There shall be no order as to
costs.
5. Registry is directed to return the original documents,
if any, upon submission of Xerox copies and after proper
identification.
Miscellaneous applications pending, if any, shall
stand closed.
