WRIT PETITION No.9216 of 2025
ORDER:
After arguing at length, learned counsel appearing
for the petitioner seeks permission of this Court to
withdraw the present writ petition with a liberty to make
a fresh application before respondent No.2 for issuance of
Passport furnishing all the case details referring to the
judgment of the Hon'ble Supreme Court in Vangala
Kasturi Rangacharyulu v. Central Bureau of
Investigation 1, wherein the Hon'ble Supreme Court held
that the Passport Authority cannot refuse the renewal of
passport on the ground of pendency of criminal
proceedings and accordingly directed the Passport
Authority to renew the passport of the petitioner without
raising objection relating to pendency of criminal
proceedings. Learned counsel appearing for the petitioner
also prays this Court to direct respondent No.2 to
2020 Crl.L.J.(SC) 572 NVSK,J
consider the application filed by the petitioner and pass
appropriate orders, in accordance with law. Learned
counsel has made an endorsement to the said effect on
the bundle.
2. Permission is accorded.
3. Recording the said submission, this Writ Petition is
dismissed as withdrawn granting liberty to the petitioner
to submit fresh application before respondent No.3
furnishing all the case details for issuance of Passport
and respondent No.3 is directed to consider the said
application and pass appropriate orders, in accordance
with law. There shall be no order as to costs.
Miscellaneous applications, if any pending, shall
stand closed.
