               CRIMINAL APPEAL No.1599 OF 2009

JUDGMENT:

This Criminal Appeal is filed under Section 378 (4) of Code of

Criminal Procedure, 1973 (for short "Cr.P.C") by the

appellant/complainant seeking to set aside the Judgment dated

26.03.2009 passed by the learned Additional Metropolitan Session

Judge for the Trial of Communal Offence Cases-cum-VII Additional

Metropolitan Sessions Judge, Hyderabad in Crl.Appeal No.413 of 2008

for the offence punishable under Section 138 of Negotiable

Instrument Act.

2. When the matter was listed on 06.11.2012 and 10.10.2022,

there is no representation for the appellant, as such, this Court

directed to post the matter to 11.10.2022 under the caption 'for

dismissal'.

3. Even, when the matter is listed under the caption 'for dismissal',

today, there is no representation for the appellant. It shows that the

appellant is not evincing any interest in prosecuting the matter

diligently.

Crl.Appeal No.1599 of 2009

4. Hence, the Criminal Appeal is dismissed for non-prosecution.

As a sequel thereto, miscellaneous applications, if any, pending,

shall stand closed.
