                    WRIT APPEAL No.510 of 2019

JUDGMENT: (Per Hon'ble Sri Justice Sanjay Kumar)


        The State of Telangana is in appeal against the order dated

25.02.2019 passed by a learned Judge of this Court in WP.No.3446 of

2019.


2.      By the said order, the authorities were directed to consider the

case of the first respondent-writ petitioner for appointment to the post

of School Assistant (Social Studies) by taking into consideration her

marks (50.33%) at graduation level as a valid qualification so as to

bring her within the zone of consideration.

3. Sri V. Ravichandran, learned counsel appearing for the first

respondent-writ petitioner, would inform this Court that WA.No.511 of

2019, arising out of an identical order passed in WP.No.3305 of 2019,

filed by the State of Telangana was dismissed, vide order dated

11.09.2019. A copy of the said order is placed on record.

4. Sri S. Sarath, learned Special Government Pleader attached to

the office of the learned Additional Advocate General, State of

Telangana, would point out that the Division Bench made it clear that

the order which was the subject matter of appeal in WA.No.511 of

2019 should not be treated as an order in rem and should be restricted

only to the petitioners who had approached the Writ Court and such

benefit should not be given to others who did not seek relief within

time. However, Sri V. Ravichandran, learned counsel, would point out

that that the order under appeal presently was passed on the very

same day that the order in WP.No.3305 of 2019 was passed.

5. Learned Special Government Pleader would concede that if this

is the case, the first respondent-writ petitioner would stand on par

with the first respondent-writ petitioner in WA.No.511 of 2019.

6. In that view of the matter, we find no grounds to deviate from

the view taken by the other Division Bench in WA.No.511 of 2019.

The writ appeal is accordingly dismissed. Pending miscellaneous

petitions shall also stand dismissed. There shall be no order as to

costs.
