WRIT APPEAL No.1358 of 2018
JUDGMENT: (Per the Hon'ble the Chief Justice Satish Chandra Sharma)
Learned counsel for the appellant has fairly conceded
that Section 87 of the Telangana Charitable and Hindu
Religious Institutions and Endowments Act, 1987 (for
short, "the Act"), provides for a remedy for a person, who is
claiming to be a founder or a member from the family of
the founder of an Institution or Endowment. She prays for
withdrawal of the present writ appeal with a liberty to
approach the Endowments Tribunal. However, she has
stated that in case such a petition is preferred before the
Endowments Tribunal, the observations made by the
learned Single Judge should not come in the way of the
appellant.
The aforesaid prayer appears to be reasonable.
Therefore, the writ appeal is dismissed as withdrawn
with a liberty to the appellant to approach the Endowments
Tribunal under Section 87 of the Act and the observations

made by the learned Single Judge will not come in the way
of the appellant and the Endowments Tribunal shall decide
the matter in accordance with law.
The miscellaneous applications pending, if any, shall
stand closed. There shall be no order as to costs.
