Citation : 2022 Latest Caselaw 1636 Tel
Judgement Date : 30 March, 2022

Telangana High Court
C.Srinivasulu vs The District Collector on 30 March, 2022
Bench: Satish Chandra Sharma, Abhinand Kumar Shavili
THE HON'BLE THE CHIEF JUSTICE SATISH CHANDRA SHARMA
                                  AND
THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI

       I.A.No.2 of 2017 (W.A.M.P.No.3718 of 2017
                         in/and
             WRIT APPEAL No.1912 of 2017

JUDGMENT: (Per the Hon'ble the Chief Justice Satish Chandra Sharma)

The present writ appeal is arising out of an order

dated 14.09.2011 passed by the learned Single Judge in

W.P.No.25622 of 2008.

The facts of the case reveal that the appellant/writ

petitioner came up before this Court being aggrieved by the

order dated 24.10.2006 passed by the Revenue Divisional

Officer, Gadwal, under the provisions of the Andhra

Pradesh State Public Distribution System Control Order,

2001, cancelling the authorisation granted to him. As per

the charges framed against the appellant/writ petitioner,

he was selling kerosene at higher rate to the cardholders

and after a detailed enquiry, the order was passed on

24.10.2006

, that too after following the principles of

natural justice and fair play. The learned Single Judge has

dismissed the writ petition.

The present writ appeal has been filed with a delay of

2244 days. In paragraph 7 of the application seeking

condonation of delay it has been stated that as the

authorisation of the appellant/writ petitioner was cancelled

in the year 2006, he was not having funds to file the writ

appeal and therefore, the delay has taken place in the

matter.

This Court, after careful consideration of the

application for condonation of delay, is of the considered

opinion that by making such a bald statement, the

question of condoning the delay does not arise.

The Interlocutory Application is accordingly

dismissed.

Consequently, the writ appeal stands rejected.
