WRIT APPEAL No.361 of 2017
JUDGMENT: (Per the Hon'ble the Chief Justice Satish Chandra Sharma)
Learned counsel for the appellant is fair enough in
stating before this Court that as per the directions issued
by the learned Single Judge and the interim order granted
in the present writ appeal, the respondents No.3, 5 and 6
were permitted to report on duty. However, only the
respondents No.3 and 6 have reported to duty and the
respondent No.5 has not reported to duty so far.
Therefore, the question of payment of salary to the
respondent No.5 does not arise. Learned counsel for the
appellant has stated before this Court that the respondents
No.3 and 6 are continuing in service and prays for disposal
of the writ appeal.
At this stage, learned counsel for the respondents
No.3 and 6 has stated before this Court that the
respondents No.3 and 6 are not being paid proper salary
attached to their post.
In the light of the aforesaid, the writ appeal is
accordingly disposed of with a liberty to the respondents
No.3 and 6 to submit a representation for payment of
proper salary and in case such a representation is filed, the
same shall be decided by the authority concerned in
accordance with law within a period of eight weeks.
The miscellaneous applications pending, if any, shall
stand closed. There shall be no order as to costs.
