WRIT APPEAL No.701 OF 2018
JUDGMENT: (Per the Hon'ble the Chief Justice Satish Chandra Sharma)
The appellant before this Court has filed the writ petition
being aggrieved by the order passed by the Assistant Provident
Fund Commissioner levying interest and damages and the
learned Single Judge has disposed of the writ petition with a
liberty to avail the alternative remedy.
As there is an alternative remedy available under Section
7-I of the Employees' Provident Funds and Miscellaneous
Provisions Act, 1952, this Court does not find any reason to
interfere with the order passed by the learned Single Judge.
Resultantly, the writ appeal stands dismissed.
Pending miscellaneous applications, if any, shall stand
closed. There shall be no order as to costs.
