JUDGMENT: (Per the Hon'ble the Chief Justice Satish Chandra Sharma)
The present writ appeal is arising out of the order dated
03.02.2022 passed by the learned Single Judge in W.P.No.5465
of 2022.
Learned counsel for the appellant states that the
appellant is also a title holder of the property in respect of which
survey has been ordered by the learned Single Judge. His
contention is that without impleading the appellant as a
respondent, the writ petition was preferred and the learned
Single Judge has directed the revenue authorities to conduct a
survey in the light of the F-line application dated 12.06.2019
submitted by the writ petitioner.
The order of the learned Single Judge reveals that before
undertaking any survey, the authorities shall put the writ
petitioner as well as the neighbouring land owners on notice.
In the light of the aforesaid, the authorities will certainly
issue notice to the present appellant also while carrying out any
survey in addition to all other neighbours.
The writ appeal stands disposed of accordingly.
Pending miscellaneous applications, if any, shall stand
closed. There shall be no order as to costs.
