JUDGMENT: (Per the Hon'ble the Chief Justice Satish Chandra Sharma)
The present appeal is arising out of a notice dated
07.01.2019
passed by the District Registrar, Hyderabad
(South).
The facts of the case reveal that the appellant/plaintiff
has filed a civil suit, which was pending before the
Commercial Court - cum - XXIV Additional Chief Judge, City
Civil Court, Hyderabad, and a document was filed along with
the plaint, which was unregistered. An application was
preferred by the appellant/plaintiff for impounding the
document and the matter was forwarded by the Court to the
District Registrar, Hyderabad (South). The District Registrar,
Hyderabad (South), has issued a notice on 07.01.2019 to the
appellant/plaintiff directing payment of stamp duty for the
purpose of compounding. The appellant/plaintiff has
preferred this appeal against the notice dated 07.01.2019.
This Court fails to understand as to how an appeal is
maintainable against the notice issued by the District
Registrar, Hyderabad (South). No order of the lower Court is
under challenge in the present appeal and therefore, this
Court does not find any reason to interfere with the notice
issued by the District Registrar, Hyderabad (South).
The appeal fails and is accordingly dismissed.
The miscellaneous applications pending, if any, shall
stand closed. There shall be no order as to costs.
