JUDGMENT: (Per the Hon'ble the Chief Justice Satish Chandra Sharma)
The present writ appeal is arising out of an order
dated 17.09.2009 passed by the learned Single Judge in
W.P.No.14016 of 2009.
The facts of the case reveal that the writ petition was
preferred by the respondent No.1/writ petitioner
challenging the proceedings dated 11.06.2009 by which the
tender was allotted in favour of the appellant/respondent
No.5. The tender notification was issued on 04.06.2009
and it was for providing catering contract with provisions
and man power at the Andhra Pradesh Social Welfare
Residential Educational Institutions Society for the
academic year 2009-2010. The learned Single Judge, by
an order dated 17.09.2009, has set aside the award of
work to the appellant/respondent No.5, against which the
present writ appeal has been preferred.
There is an interim order granted by this Court in the
present writ appeal on 05.03.2010.
In the facts and circumstances of the case, as the
work itself was for a period of one year, the present writ
appeal stands disposed of with a liberty to the respondents
No.2 to 5 to issue a fresh tender.
The miscellaneous applications pending, if any, shall
stand closed. There shall be no order as to costs.
