THE HON'BLE THE CHIEF JUSTICE SATISH CHANDRA SHARMA
AND
THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI
WRIT APPEAL No.234 of 2022
JUDGMENT: (Per the Hon'ble the Chief Justice Satish Chandra Sharma)
The present writ appeal is arising out of an order
dated 19.01.2022 passed by the learned Single Judge in
W.P.No.2309 of 2022.
The facts of the case reveal that some complaint was
made by the appellant/writ petitioner to the police and
based upon the so-called complaint made by the
appellant/writ petitioner, the Assistant Commissioner of
Police has directed the appellant/writ petitioner to produce
certain documents. The appellant's/writ petitioner's
contention is that she has produced all the documents and
the police are not taking any further action in the matter.
There is a dispute between the parties in respect of a
share in a rice mill and such a dispute, which is purely of
civil nature, can be adjudicated in a civil suit and not by
the police. The appellant/writ petitioner wants the police
to investigate and settle the dispute. The learned Single
2
Judge has disposed of the writ petition with a liberty to
take recourse to other remedies available under the law.
This Court does not find any reason to interfere with
the order passed by the learned Single Judge.
The writ appeal is accordingly dismissed.
The miscellaneous applications pending, if any, shall
stand closed. There shall be no order as to costs.
