COMMON ORDER:
Respondent No.2 died and respondent Nos.3 to 6 are not
necessary parties.
I.A.No.4 of 2021 is filed under Order 23 Rule 3 C.P.C. read
with Section 151 C.P.C. with a prayer to record the compromise and
allow the Appeal in terms thereof.
CCCA.No.29 of 2021 arises out of the order dated 23.11.2020
passed by the learned XXVI Additional Chief Judge, City Civil
Courts, Hyderabad, in I.A.No.975 of 2011 in O.S.No.527 of 2007.
Both the parties are present in the Court and produced their
respective identity proofs. They are all identified personally by the
learned counsel appearing for them. They stated that on the advice
of the elders, they had settled the dispute among themselves and all
of them agreed that out of their own free will and volition, they have
entered joint memorandum of compromise, which was reduced into
writing on 05.07.2021 and signed by the appellants and respondent
No.1.
As per the said compromise, respondent No.1 had agreed to
receive a sum of Rs.60,00,000/- to forego her claim with respect to
the suit schedule property in terms of the judgment and decree.
Hence, I.A.No.4 of 2021 is ordered and the Appeal is disposed
of in terms of memorandum of compromise. The parties to bear their
own costs. The terms of compromise shall form part of the order.
Miscellaneous petitions, if any pending, shall stand disposed
of.
