JUDGMENT: (Per the Hon'ble the Chief Justice Satish Chandra Sharma)
The present writ appeal arises out of an order dated
02.11.2021 passed by the learned Single Judge in
W.P.No.27569 of 2021.
The appellant herein has stated before this Court that
he was not a party to W.P.No.27569 of 2021 and the learned
Single Judge has directed the Commissioner & Inspector
General of Stamps & Registration, Hyderabad, to decide the
complaint of the writ petitioner.
Paragraphs 2 and 3 of the order passed by the learned
Single Judge in W.P.No.27569 of 2021 are reproduced as
under:
"2. This writ petition is filed questioning the action of
the respondents in not considering the representation/
complaint dated 26.07.2021 made by the petitioner requesting to initiate necessary action against the persons, who played fraud on his mother and got the sale deed executed in their favour, in accordance with Section 82 of the Registration Act, 1908.
3. Having regard to the nature of grievance expressed by the petitioner, without going into the merits or demerits of the case, the Writ Petition is disposed of directing the respondent No.2 - the Commissioner & Inspector General of Stamps & Registration, Hyderabad, to consider the representation/complaint of the petitioner dated 26.07.2021 and pass necessary orders thereon, strictly in accordance with law, as expeditiously as possible, preferably, within a period of eight weeks from the date of
receipt of a copy of this order, duly putting on notice all the interested persons and considering the objections, if any.
Pending miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs."
The facts of the case reveal that a representation/complaint was submitted by the writ
petitioner/respondent No.5 herein to the District Registrar
requesting for an action under Section 82 of the Registration
Act, 1908. The learned Single Judge has disposed of the writ
petition with a direction to the Commissioner & Inspector
General of Stamps & Registration to decide the
representation/complaint, that too, after putting on notice all
the interested persons.
Therefore, this Court does not find any reason to
interfere with the order passed by the learned Single Judge.
The writ appeal is accordingly dismissed. The
miscellaneous applications pending, if any, shall stand
closed. There shall be no order as to costs.
