        CIVIL REVISION PETITION No. 4946 of 2017

ORDER:

Heard learned counsel for petitioner.

None appears for respondents.

The specific complaint of the petitioner is that there is no

separate order dated 08.09.2010 passed in E.P.No.121 of 2007 in

O.S. No. 3816 of 1983.

Taking into consideration the specific assertion of the

petitioner, this Court vide order dated 19.09.2017 directed the

learned I Junior Civil Judge, City Civil Court, Secunderabad, to

file a report. In the letter dated 09.10.2017, the learned I Junior

Civil Judge, City Civil Court, Secunderabad, had stated that in

spite of search of dictation notes, fair copy registers and draft

judgments and orders, separate order in E.P.No.121 of 2007 was

not found.

In those circumstances, the order under revision, wherein it

was stated that the orders are pronounced vide separate order,

which is missing, is set aside with the direction to the Court

below to hear the matter de novo and pass orders on merits, in CKR, J

accordance with law, within a period of six (6) months from the

date of receipt of a copy of this order.

Accordingly, this Civil Revision Petition is allowed.

Miscellaneous applications, if any pending, shall stand

closed. There shall be no order as to costs.
