1. The case comes up on an application (No.01/2025) preferred

under Section 5 of the Limitation Act for condonation of delay in

filing the present appeal.

2. The application is not opposed by learned counsel for the

respondent.

3. For the reasons mentioned in the application, the same is

allowed. The delay of 404 days in filing the present appeal is

condoned.

4. Heard learned counsel for the parties on appeal itself.

5. The present special appeal has been filed against the order

date 20.03.2024 passed by the learned Single Judge, whereby,

the writ petition filed by the respondent-petitioner has been

disposed of in light of the judgment dated 02.08.2023 rendered by

this Court in the case of Rajesh W/o Late Shri Satveer Singh

Vs. State of Rajasthan & Ors (S.B. Civil Writ Petition

No.5553/2021).

6. Learned counsel for the parties submit that strictly speaking

the controversy involved in the facts and circumstances of the

present case is not squarely covered by the judgment rendered in

the case of Rajesh (supra), therefore, the matter may be

remanded back to the learned Single Bench for adjudication on

merit.

7. In view of the submissions made before this Court, the

present special appeal is allowed. The order dated 20.03.2024

passed by the learned Single Judge is quashed and set aside and

the matter is remanded back to the learned Single Bench for

deciding it afresh on merit.

8. The stay application as well as other pending misc.

application, if any, stand disposed of accordingly.
