Heard learned counsel for the petitioners.

Learned counsel for the petitioners submits that the

controversy involved in the present case is squarely covered by a

judgment rendered in S.B. Civil Writ Petition No.2197/2022

(Om Prakash Biwal and Anr. Vs. State of Rajasthan and

Ors.) decided on 16.01.2023 in the following terms:-

"7. Having heard counsel for parties and perused the material available on record, this Court is of the view that the petitioners are entitled to due benefits of old pension scheme, seniority, allowances and other relevant benefits as has been granted to similarly situated selectees of advertisement dated 28.07.2003. Petitioners shall be granted actual due benefits from the date of their appointment and relevant benefits shall be notionally.

8. The writ petition stands disposed of accordingly. The due exercise for compliance of this order be made within a period of three months from today.

9. Stay application and all pending application(s), if any, also stand disposed of."

Learned counsel for the petitioners prays that the petitioners

may be permitted to file an appropriate representation in the light

of judgment rendered in Om Prakash Biwal (supra) for the

redressal of their grievances before the respondent-authorities

and the respondents may be directed to consider and decide the

same expeditiously.

Considering the limited prayer made by learned counsel for

the petitioners, the present writ petition is disposed of with a

liberty to the petitioners to file an appropriate representation

before the respondent-authorities for the redressal of their

grievances in the light of the judgment rendered in the case of Om

Prakash Biwal (supra) and the respondents are directed to decide

the same expeditiously preferably within a period of four weeks

from the date of such representation, strictly in accordance with

law.

It is made clear that the present writ petition is disposed of

in view of the submissions made by the learned counsel for the

petitioners and, therefore, the respondents are directed to

consider and decide such representation on its own merit and pass

a speaking order.

It is also made clear that this Court is not expressed any

opinion on the merits of the matter and the respondents shall

consider and decide the same on its own merit.
