AWARD OF LOK ADALAT

The matter is placed before the Lok Adalat today.

The MACT, Abu Road, District Sirohi by its judgment and award dated 19.10.2019 in MAC Case No. 32/2016 awarded a sum of Rs. 10,90,000/- alongwith interest @ 6% per annum.

With the active efforts of Counsel representing the parties and the authorities of the Insurance Company, the controversy involved in this appeal has been settled by mutual compromise in the spirit of Lok Adalat. We appreciate the efforts of all concerned in settling the matter in pre-counselling. The memo of understanding shall constitute a part of the award.

With the consent of the parties, the impugned award dated 19.10.2019 is further enhanced by Rs. 3,00,000/- in favour of the claimant(s) as a full and final settlement of the case. The amount so agreed shall be deposited by the respondent Insurance Company with the Tribunal within a period of two months from today failing which, the same shall carry interest @ 7.5% per annum from the date of this order till actual realization. The enhanced amount of

compensation be disbursed in terms of the award in the saving bank account of the claimant(s) without insisting upon FDR. The award impugned dated 19.10.2019 passed by MACT, Abu Road, Sirohi in Claim Case No. 32/2016 is modified accordingly.

In view of the above, the appeal is disposed of.

The Registry is directed to send back the record forthwith.
