1. Petitioner herein is seeking directions to the respondents to

accord benefit of old pension scheme and notional and

consequential benefits from the date the persons junior to the

petitioner were granted the same.

2. At the outset, it is submitted by learned counsel for the

petitioner that the issue raised in the present writ petition is

covered by an order dated dated 08.02.2012 passed in Ashok

Kumar Baser Vs. State of Rajashtan & Ors. : S.B. Civil Writ

Petition No.6707/2007 and order dated 10.07.2017 passed in Om

Prakash Beniwal : S.B. Civil Writ Petition No.8204/2014. He

submits that the petitioner is sanguine that, in case she is allowed

[2025:RJ-JD:4291] (2 of 2) [CW-1348/2025]

to file a representation individually qua the grievance raised in the

present writ petition and the same is considered in light of the

aforesaid judgment, she will be meted out with favorable

treatment.

3. In view of the aforesaid, without commenting on the merits of

the case, the petition filed by the petitioner is disposed of with a

direction to the competent authority to decide the representation

(may file fresh, if not already filed) of the petitioner, in accordance

with law, keeping in view the observations made in the case of

Ashok Kumar Baser and Om Prakash Beniwal (supra), as

expeditiously as possible.
