1. Learned counsel for the appellant submits that the impugned

order dated 07.07.2004 passed by the learned District and

Sessions Judge, Rajsamand under Section 9 of the Arbitration and

Conciliation Act, 1996 (for short 'the Act of 1996') was in force

only upto the filing of application under Section 34 of the Act of

1996. Since the limitation period for filing the application has

already got over way back in the year 2004 itself and the

impugned order dated 07.07.2004 has ceased to be operative, the

instant civil misc. appeal has become infructuous.

2. The instant civil misc. appeal is dismissed accordingly.
