Learned counsel for the respondents, at the outset, submits

that the controversy involved in the present case is squarely

covered by Co-ordinate Bench judgment of Lokendra Singh vs.

State of Rajasthan & Ors. (S.B. Civil Writ Petition No.

10008/2017; decided on 30.11.2017), wherein the issue was

decided in favour of the State.

[2024:RJ-JP:1915] (2 of 2) [CW-3888/2017]

Learned counsel for the petitioner could not refute the

dictum of the aforesaid judgment.

In view thereof, the present petition stands dismissed in light

of Co-ordinate Bench judgment of Lokendra Singh (supra).

Pending application(s), if any, shall stand disposed of.
