1. Learned counsel for the appellant submits that on account of

some miscommunication, the present appeal on behalf of the

appellant has been presented, whereas qua the same impugned

judgment dated 13.06.2023, already an appeal being D.B. Cr.

Appeal No.92/2023 filed on behalf of the appellant is pending

consideration before this Court and therefore, the appeal may be

dismissed as withdrawn.

2. In view of the submissions made, the present appeal is

dismissed as withdrawn with liberty to pursue D.B. Cr. Appeal

No.92/2023.

3. The application seeking suspension of sentence also stands

disposed of.
