Learned counsel for the appellants fairly does not dispute

that the issue involved herein is no more res-integra and stands

[2023:RJ-JP:29587] (2 of 2) [CSA-319/2014]

resolved and is covered by a judgment passed by this Court in

case of Bachhu Singh versus RSRTC: SB Civil Writ Petition

No.3783/2000 wherein, it was held that in case of loss of tickets

by a Conductor/Window Clerk, in absence of any evidence of

misuse of such lost tickets, the total amount of such lost tickets is

not recoverable except the printing cost of such tickets.

Appreciating the gesture shown by the learned counsel for

the appellants, these civil second appeals are dismissed.

Pending application also stands disposed of accordingly.
