1. An application has been preferred on behalf of the petitioner

with a prayer for clarification/modification in the order dated

03.10.2023 passed by this Court.

2. It has been submitted by learned counsel for the applicant

that the averment of the counsel as noted in para No.6 of the said

judgment/order to the extent that M/s Mafatlal Industries Ltd.

was a case pertaining to income tax has inadvertently been noted

whereas the submission of the counsel was that the matter

pertains to 'Central Excise Act'. Learned counsel submits that the

said averment of the counsel be clarified/modified.

3. In view of the submission made, the application is allowed. It

is clarified that in the order dated 03.10.2023 the averment of the

counsel for the petitioner was that M/s Mafatlal Industries Ltd.

was a matter pertaining to Central Excise Act.
