1. Mr. Rajpurohit, learned counsel for the petitioner submits

that the issue involved in the present writ petition has been set at

rest by a judgment of Co-ordinate Bench of this Court rendered in

the case of Shiv Lal Meena Vs. State of Rajasthan & Ors. (S.B.

Civil Writ Petition No.15608/2018, decided on 06.10.2018). He

also relied upon even in the case of Teacher Grade-III (Level-I)

has held the issue in petitioner's favour in the case of Kiran Meena

Vs. State of Rajasthan & Ors. (S.B. Civil Writ Petition

No.11612/2019, decided on 17.08.2022).

2. Learned counsel for the petitioner submitted that the

petitioner having secured 57.33% marks is eligible to be

appointed as Teacher Grade-III (Level-I) in TSP area.

3. Mr. Deepak Chanda, learned counsel for the respondent -

State argued that though the argument advanced by petitioner

has substance particularly in light of the above judgments passed

by this Court, but since two more recruitments for Teacher Grade-

[2023/RJJD/017806] (2 of 2) [CW-11626/2019]

III (Level-I) have been held by the State (in 2021 & 2022) after

the subject recruitment, the post if any which remained unfilled

must have been carried forward and taken into account in the

subsequent recruitment and therefore, petitioner cannot be given

appointment at such belated stage.

4. Mr. Rajpurohit, prays for and is granted three days' time to

satisfy the Court as to how the petitioner can be granted

appointment.

5. List this case on 01.06.2023.
