1. The instant criminal leave to appeal has been preferred

against the judgment dated 20.01.2018 passed by learned

Additional Sessions Judge No.1, Chittorgarh in Criminal

Appeal No.40/2016 whereby the learned appellate Court

reversed the judgment passed by learned Special Judicial

Magistrate (N.I. Act Cases) Chittorgarh.

2. A cursory look over the material available and the fact that

the Court of first instance has found the offence proved

against the accused respondent persuaded this Court to

interfere in this matter. Thus, there seems reasonable

grounds to allow the petitioner to prefer an appeal against

the impugned judgment.

3. Accordingly, the instant application seeking leave to appeal

is allowed. The memo of leave to appeal application shall be

treated and registered as an appeal.

4. Office to proceed.
