Heard on the application under Section 5 of the
Limitation Act.
It is stated that the petitioner is incarcerated since last
seven months and since there was no one present to pursue his
cause, therefore, he was precluded from filing the petition within
the period stipulated by the statute.
Considering the grounds raised and taking a lenient
view as the petitioner is behind the bars, the application under
Section 5 of the Limitation Act is allowed and the delay in filing the
revision petition is condoned.
Heard and considered the submissions advanced by the
learned counsel for the parties and perused the material available
on record.
Considering the fact that there are arguable points on
the legality and correctness of the judgment of conviction passed
(2 of 2) [CRLR-108/2023]
by the trial court and affirmed by the appellate court, I deem it
appropriate to admit the petition.
Admit.
Notice need not be issued as learned counsel Mr. D.S.
Gharsana is appearing for the complainant. Thus, service is
complete. Call for the record.
