Counsel for petitioner states that the application for
rectification is maintainable by way of the instant writ petition
before the High Court, in view of Section 125 of the
Trade Marks Act, 1999.
It has been noticed that the registration of trademark "Shri
Anmol Gold" of the non petitioner No.1 was made on 20 th August,
2013. Therefore, petitioner instituted civil suit bearing
No.6967/2015 (1/2016) against the non petitioner No.1, but the
said civil suit has been dismissed on merits vide judgment dated
12.09.2018. It has been informed that thereagainst a civil first
appeal No.897/2018 has been filed which is pending before the
High Court.
Let the notice be issued to respondents subject to their
objection about maintainability of this writ petition before the High
Court.
