The present appeals were heard and the judgment was

reserved on 04.01.2023.

Meanwhile in S.B. Civil First Appeal No. 430/2017 an

application has been preferred on behalf of the appellants with a

submission that one of the appellants namely Renu D/o Late Shri

Sharwansingh has expired on 19.08.2022 and her name may be

deleted from the array of appellants.

In view of the fact that appellant No.2-Renu was one of the

dependents of the deceased qua whose death, the claim petition

was filed and was decreed by the learned Court below, in the

opinion of this Court, deletion of her name would not prejudice the

rights of any of the other claimants.

The application is therefore, allowed. The name of appellant

No.2-Renu is permitted to be deleted from the array of appellants

at the risk of the appellants.

The amended cause title as filed in Civil First Appeal

No.430/2017 is taken on record.

So far as, Civil First Appeal No.327/2017 is concerned, the

name of respondent No.2-Renu is deleted with the consent and at

the risk of the respondents.

Let the amended cause title be filed in Civil First Appeal

No.327/2017 within a period of one week.

List the matters on 16.01.2023.
