HON'BLE MR. JUSTICE SUDESH BANSAL Order 09/02/2023 Instant first appeal has been filed by plaintiff, assailing the
judgment and decree dated 12.09.2018, whereby and whereunder
its suit for passing off action of trademark, rendition of accounts
and damages under provisions of 134 of the Trade Marks Act,
1999 has been dismissed on merits.
Respondent has already put in appearance and service
stands complete.
Record has already been received.
Heard.
Admit.
Counsel for appellant submits that during course of trial,
though the application for temporary injunction was allowed, but
in appeal, the High Court stayed the operation of stay order and
therefore, the stay application filed along with appeal be posted to
be heard with the appeal itself.
