1. At the outset, learned counsel for the petitioner submits that

the controversy involved in the petition is squarely covered by a

judgment dated 13.10.2023 rendered by this Court in S.B. Civil

Writ Petition No.16317/2023: Bhanwar Lal Vs State of Rajasthan &

others. He seeks liberty to file an appropriate representation

(2 of 2) [CW-19106/2023]

before the competent authority of the respondents, provided the

same is decided in the light of judgment ibid.

2. In view of the aforesaid submission, the present writ petition

filed by the petitioner is disposed of, with liberty to the petitioner

to submit a fresh representation to the respondents. The

competent authority of the respondents shall consider and decide

the same in the light of aforesaid decision in Om Prakash's case

(supra). In case the said judgment is not applicable, specific

reasons thereof shall be given by passing a speaking order.

3. The order has been passed based on the argument of the

learned counsel for petitioner and the respondents would be free

to examine the veracity of the submissions made in the petition

and only in case, the averments made therein are found to be

correct, the petitioner would be entitled to any relief.
