After attempting to argue the matter on merits for quite

some time, learned counsel for the appellant on instructions

submits that he wants to withdraw this special appeal writ,

however, seeks liberty for the appellant to raise all his available

grounds before the learned Single Judge in the pending writ

petition filed by him.

Hence, this special appeal writ is dismissed as withdrawn

with the liberty as prayed for.
