Heard learned counsel for the petitioner.

Learned counsel for the petitioner submits that petitioner is

due to retire on 31.07.2024, therefore, as less than two years are

left for his superannuation, he is now now being transferred from

Raniwada to Ahmedabad. He submits that the transfer order is in

violation of the judgment of this court in the case of Dr. Smt.

Pushpa Mehta Vs. Rajasthan Civil Services Appellate

Tribunal & Ors. reported in 2000 1 RLW (Raj) 233 decided on

16.12.1999.

Matter requires consideration.

Issue notice to the respondents. Issue notice of stay

application also, returnable on 18.05.2023.

Meanwhile and till the next date of hearing, effect and

operation of the transfer order dated 28.03.2023 (Annex.3) and

the relieving order dated 01.04.2023 (Annex.4) shall remain

stayed.
