Mr. Sushil Bishnoi, learned counsel appears for the
respondent submits that copy of the memo of appeal as well as
the application under Section 5 of the Limitation Act has not been
supplied to him.
Learned counsel appearing for the appellant is directed to
supply the same to learned counsel appearing for the respondent.
Learned counsel appearing for the respondent prays for and
is granted four weeks' time to file reply to the application under
Section 5 of the Limitation Act.
List the matter after four weeks.
Till then, if the appellant deposits a sum of Rs. 2 lacs within
a period of one month from today in the trial court or pay the
same directly to the respondent, effect, operation and execution of
the impugned judgment and decree dated 15.02.2018 passed by
learned Additional District Judge No.1, Hanumangarh in Civil Suit
(2 of 2) [CFA-207/2019]
No.101/2011(CIS No.513/2014) and execution proceedings in
Execution Petition No.36/2018 pending before learned Additional
District Judge No.1, Hanumangarh shall remain stayed.
