Learned counsel for the petitioner-institution has placed
reliance on the order dated 6.1.2022 passed by the Coordinate
Bench of this Court in Shri Vinayaka Mission Medical &
Education Society Vs. State of Rajasthan & Ors. (SBCWP
No.17202/2021) and submitted that in the identical writ
petition, this Court has already directed the respondents to allow
(2 of 2) [CW-7285/2022]
the petitioner-institution to admit the students in B.Sc. (N)
Course provisionally.
Issue notice.
Mr. Manish Vyas, AAG is directed to accept notice for
respondent No.1.
Let notice be issued to the respondent Nos.2 to 4 only,
returnable on 27.07.2022.
Meanwhile, in case due fees is deposited, the respondents
shall permit the petitioner-institution to provisionally participate in
the future ongoing counseling for B.Sc.(N) Course for the
academic session 2021-22 with intake capacity of 50 seats.
Admission granted to the students in the above-referred
course pursuant to this interim order shall be provisional and
intimation to this effect and pendency of the writ petition shall be
reflected by the petitioner-institution on its website so also while
giving admission to the students.
