Mr. O.P. Mehta, learned counsel for the petitioner submits
that due to personal reasons, learned Senior Counsel Mr. R.N.
Mathur is unable to appear today before this Court, therefore the
matter may be adjourned to post vacation.

An oral undertaking by the parties was earlier made before
this Court that they shall request the learned trial court not to
proceed with the final decision in temporary injunction application.
Learned counsel for the respondent Mr. HR Soni submits that
since the hearing of temporary injunction application is complete,
therefore, the liberty may be given to the learned trial court to
decide the temporary injunction application and he suggests that
the effect and operation of the judgment in temporary injunction
application be stayed until the further order on merits is passed by
this Court in the interest of justice.
On such fair submission made by learned counsel for the
respondent, the matter is posted on 15.07.2022 for further
hearing.
In the meanwhile, learned trial court shall have the complete
liberty to proceed with the temporary injunction application and in
case any judgment in temporary injunction application is passed,
the same shall not be given effect to, till 15.07.2022.
