Learned Counsel appearing for the appellant-Insurance

Company submits that the entire awarded amount has been

deposited and certain awarded amount is lying in fixed deposit in

terms of the impugned judgment and award and the same may

not be permitted to be encashed during the pendency of the

appeal.

Having regard to the facts and circumstances of this case

and looking to the fact that the impugned award has already been

executed, the following amount lying in fixed deposit may not be

encashed without the leave of this Court and/or any further orders

be passed by this Court.

1. Smt. Kamla Devi- Rs. 5,00,000/- (9years)

2. Yash- Rs. 11,00,000/- (minor)

3. Varsha- Rs. 11,00,000/-(minor)

Stay application is stand disposed of accordingly.
